ABSTRACT

With a view to the evolution of the theory of contracts, the requirements of contractual justice and the obligation to harmonize rights, the judge must play a corrective role within the contractual relation. He must be guided by the values of justice and the need to maintain a contractual balance. Therefore, the law system recognizes the possibility for the judge as well as for the legislature to intervene in the contractual relation.
