Instruments for the unification of judicial practice in the matter of the limits for the exercise of property rights

Abstract

The analysis found in the paragraphs below represents a selection of the most relevant judgments and solutions rendered in matters of the limits for the exercise of property rights, addressing the facets of this institution from more perspectives. The most common situations that required intervention for the harmonization of interpretation and legal application are those related to the reconstitution of property rights, expropriation, or public utility easements. For more common matters, such as dismemberment of property rights or the right of preemption, the need for intervention to unify practice has been rarer.
