ABSTRACT

The existence of conflict situations between parents or parents and persons entitled to exert parental authority or at the domicile, where the minor child has his/her residence - according to the provisions of the New Civil Code - has led to the appearance of a crime that is very significant to minor children, as they are withdrawn from their familial and social environment, whereby damages occur, which are sometimes irreparable.

In this article, the author analyses the offence of non abidance by measures for child entrustment from the perspective of the New Criminal Code, starting from a brief presentation of this crime, as it was specified in the older Romanian penal laws, respectively by the Criminal Code of 1936 and the Criminal Code of 1968.
