The ineffectiveness of suretyship. The benefit of subrogation Observations in regard to decision no. 208/2021 of the Timişoara Court of Appeal

Abstract

The current paper focuses on the benefit of subrogation, i.e., a mechanism that exists in the field of suretyship, and that was used by the Timişoara Court of Appeal in a 2021 decision. Our work begins with an introduction (no. 1). After that, in a very brief manner, the benefit of subrogation is highlighted (nos. 2-8). Our research ends with some observations relating to decision no. 208/2021.
