Abstract

The protection of the individual by civil law means aims to protect the rights and legitimate interests of the individual, whether pecuniary or non-pecuniary. Following the court's order of guardianship, the interests of the individual are represented by the guardian - the person legally appointed by the guardianship court.

Removal of the guardian from the exercise of the guardianship is a sanction applied by the guardianship court in case of abuse, gross negligence, other acts that make him/her unworthy to be a guardian, in case of failure to properly perform his/her duties, as well as in other cases provided by law (art. 113 Civil Code).
