ABSTRACT

Scientific intercession of the article below has incidents which some of the rules of new Civil Code has it on collective employment agreement, chiefly as regards legal regime of the negotiations in pre-contractual phase.

Civil Code rules in general, and those governing "general theory of contract" in particular, are considered to be common law labor Code in general, also collective agreement in particular. They also have in their contents rules which have as their object the regulation stage of precontractual negotiations, representing a new legislative absolutely necessary in present.
