Law implications on street art. Limitations

Abstract

Protecting urban art represents nowadays a complex legal issue, mainly because its object is in a state of vulnerability. This is caused by the location in which the act of creation is performed or in which art took place. Most certainly, street art is protected by copyright rules. The use of these rights, conferred by the regime, is possible, but unfortunately limited when it comes to competing rights. The future leans towards legality and contractual exploitation.

It is indeed indispensable for art theory to take into account the legal dimension, in particular the impact of copyright on the practices of making cultural objects.
