Abstract:

There is an organised criminal group, if the defendants acted for a period of time and in a coordinated manner, each of them performing well established roles in the carrying out of the criminal plan, for the purpose of committing the offence of traffic in persons provided under art. 12 of Law no. 678/2001, in order to obtain a financial benefit or another material benefit, and the initiation and creation of such a group comes within art. 7 par. (1) of Law no. 39/2003.

The recruitment, transport abroad and accommodation for several persons, under threat, violence and other forms of coercion, for the purpose of exploiting them by forcing them to commit offences such as the theft of goods later sold by the defendants, meet the conditions for the offence of traffic in persons provided under art. 12 of Law no 678/2001, forcing the victims to commit the offence of theft of goods constituting a serious form of exploitation in the sense...
