Abstract

The following conditions must be cumulatively met in order to be in the presence of a strike: the works ceases in any form within a unit (the cessation of work does not need to affect all subunits or the departments of the employing unit), the cessation shall be collective (it does not involve only special, particular cases) and it shall be voluntary, namely it shall not be required by objective and external factors (the employees shall not be prevented from working for reasons beyond their control).
