Abstract

Rule of art. 204 of the Code of civil procedure expressly regulates the fact that the change must originate from the plaintiff, namely from the author of the action representing the document instituting the proceedings.

Therefore, law allows that the plaintiff should amend the action only in terms of its object, of the cause and of the defendant, and the amendment shall not be admissible as regards the former.

Rezumat

Norma art. 204C. pr. civ. reglementează expres faptul că modificarea trebuie să provină de la reclamant, adică de la titularul acţiunii ce constituie actul de sesizare a instanţei de judecată.

Ca atare, legea permite ca reclamantul să modifice acţiunea numai sub aspectul obiectului, al cauzei şi al pârâtului, nefiind admisibilă modificarea sub aspectul persoanei reclamantului.
