Abstract

Extension of criminal proceedings for other substantive deeds. Article 335 (2) under the Criminal Procedure Code.

Should it be ascertained that the deed under trial does not constitute an offence distinct of cheating, but a substantive deed falling within the boundaries of an offence on ongoing basis for which a final judgment of conviction was sentenced, the Court convenes in the case with the one for which a final judgment of conviction was ruled and passes a new judgment condemning all substantive deeds falling within the boundaries of the offence of cheating on ongoing basis, in accordance with Article 335 (2) under the Criminal Procedure Code, abolishing the previous judgment of conviction.
