Civil action in criminal proceedings by successors. Conditions of admissibility
Abstract
Civil action in criminal proceedings is governed, inter alia, by the principle of availability and is ancillary to criminal proceedings. The injured person has a right of option, either to bring a civil action in criminal proceedings or to bring a civil action in the civil court. Insofar as they choose to bring civil proceedings in criminal proceedings, they must satisfy the conditions laid down by law to be legally constituted as a civil party. If, during the course of the proceedings, the civil party dies, the heirs have the right to opt to continue the civil action. This right may be exercised only if their predecessors were constituted as civil parties within the time allowed by law and in compliance with all the conditions of admissibility; otherwise, the action is inadmissible.
