Does the challenge against the trial deferral represent an annulment remedy?

Abstract

The challenge against the trial deferral represents a new institution in the Romanian procedure to sue, an expression of the constant recommendations of the European Court of Human Rights addressed to the contracting states to adopt and enforce internal remedies for the cases of deferral of judicial proceedings. This proceeding profile outlined by the legislator raises questions regarding the way in which this remedy at law is included in the overall consecrated remedies at law and regarding its character.
