Great news for international arbitration with the fresh release of the 2025 School of International Arbitration at Queen Mary, University of London- White & Case 2025 International Arbitration Survey - The path forward: Realities and opportunities in arbitration showcasing 87% of respondents' preference for international arbitration to resolve cross-border disputes, either as a standalone mechanism (39%) or with ADR (48%) with only 4% opting for cross border litigation. From its summary we cite: the most preferred arbitral rules - ICC Rules, HKIAC Rules, SIAC Rules, LCIA Rules and UNCITRAL Rules with the top seats for arbitration being London, Singapore, Hong Kong, Beijing and Paris. In regard to efficiency and effectiveness, the Survey cites behaviours that most negatively impact efficiency in arbitration: adversarial approaches by counsel (24%), lack of proactive case management by arbitrators (23%) and counsel over-lawyering (22%).
