Among the developments relevant for international arbitration standing out this (already past) summer we bring to your attention below that:
On 26 June 2024 the representatives of the Governments of 26 out of 27 Member States and of the European Union made a Declaration on the legal consequences of the judgment of the CJEU in Komstroy and common understanding on the non-applicability of Article 26 of the Energy Charter Treaty (ECT) as a basis for intra-EU arbitration proceedings, with Hungary adopting a separate declaration, taking the position that the nonapplication of the ECT in intra-EU disputes must be achieved in accordance with the Vienna Convention on the Law of Treaties and principles of public international law.This was followed on 25 July 2024 by the European Commission deciding to open an infringement procedure by sending a letter of formal notice to Hungary (INFR(2024)2206) for undermining the Union's position on the international stage...
