Public domain of the state. Partial annulment of a government decision. Action brought by the Romanian national water administration

Abstract

The plaintiff, the "Romanian Waters" National Administration - B.-I. Water Basin Administration, in contradiction with the Government of Romania and the territorial administrative units requested the partial annulment of Government Decision no. 1303/2011, claiming that the respective ponds indicated in the mentioned positions are in the public domain of the state and in its administration, and, by including the respective real estate in the local public domain of the mentioned communes, the provisions of art. III para. 3 of the Annex to Law no. 213/1998, as well as the provisions of Law no. 107/1996.
