Abstract

A new element powered by the entry into force of the new Civil Code is also the change in the matter of the legal person, as well as under the terms of the normative source for its general legal status and under its content. The recent legislative framework is a milestone reporting and a complementary legal source including credit institutions, private legal person which are the expression of a number of features drawn from a rich banking and commercial law. A contribution to the acquisition of the cited special status belongs to the process of establishment of these categories of legal persons, witch requires the compliance of the imperative cumulative conditions set by the legislator regarding the constitutive document, the authorization process and the records.
