Dispoziţii legale contradictorii privind interdicţia concedierii liderilor sindicali

ABSTRACT

The Labour code contains two conflicting texts regarding the dismissal of Union leaders. While art. 60 para. (1) lit. g) prohibits their dismissal, unless they commit a serious disciplinary offense or repeated, art. 220 para. (2) provides that the elected representatives in the governing bodies of trade unions cannot be dismissed "only for reasons related to the fulfilment of the mandate received from the employees in the organization". The latter text is similar to that of art. 10 of Law No. 62/2011. The author examines the texts in question and proposes solution to be adopted in practice.
