Abstract

The present paper intends to analyse the problem of embezzlement, the offense under article 295 of the Romanian Criminal Code. Not only because of the sheer novelty of the provision, but also because of the frequency of this offense being committed in the workplace, a constant debate is required. The author analyses these aspects by comparison between the former and the current criminal provisions regarding embezzlement, highlighting both the evolution and the aspects according to which the former legislator has proven to be more inspired than the current legislator.
