Abstract

As, in this case, the entry into the country of the quantity of high risk drugs represented a mean offense, since the purpose offense of the defendant consisted of owning drugs entered for own consumption, and the cross-border element was exclusively carried out for own consumption, the defendant’s offense meets the typical nature requirements of the offence provided for under art. 4 paragraphs (1) and (2) of Law no. 143/2000, absorbing in its content the offence of entering high risk drugs into the country, provided for under art. 3 paragraphs (1) and (2) of Law no. 143/2000.
