ABSTRACT

The date of 1 February 2014 has a special relevance to the Romanian legal framework. It marks the entering into force of the New Criminal Code and of the New Criminal Procedural Code, but also of the amendments to Law No. 182/2002 on classified information and Law No. 51/1991 on national security, respectively relating to a simplified procedure for access by magistrates to classified information, and to judicial authorization of activities concerning the handling of certain information, performed by the Romanian secret service.

As a result of the amendments to Law No. 182/2002, the Superior Council of Magistracy (CSM) adopted Regulation No. 140/2014 on the procedure for magistrates accessing classified information, which is in force as of 7 February 2014.
