Abstract
The lease agreement in the case at issue does not regulate the assumption of the payment of the rent or the payment of the utilities further on until the date of effective evacuation, consequently, the debts accumulated after the indicated period and until the date when the respondents evacuated the immovable asset may be capitalized only by reference to the general provisions in this matter. Thus, according to the provisions of Art. 1831 para. (2) of the Civil Code, the lessee has the obligation to pay the rent provided in the agreement until the date of effective evacuation of the dwelling.
