Under the provisions of Law No. 136/1995, the amount of indemnity awarded by the insurer should the risk insured occur may not exceed the value of the asset at the moment of occurrence of the risk insured, the amount of damage or the amount covered by the insurance.

Thus, the circumstance that the insurer has agreed to insure the asset to a value greater than that of its purchase may not be raised as a basis for reducing the amount of indemnity to an amount lower than the amount of the insurance indemnity agreed upon under the insurance policy, in the absence of a clause taken upon by both Parties in this regard.
