Content of the right to information and consultation of the employees’ representatives as regards the collective dismissal
Abstract
The employer is not required to communicate to the Trade Union the name list of the employees to be dismissed, however, “the number and categories of employees who shall be affected by such dismissal”.
The relevant information to achieve such goal provided for under art. 69 paragraph (1) of the Labour Code, shall not be verified by the name indication of all employees to be subject to redundancy. As expressly provided for under art. 69 paragraph (2) letters a) and c) of the Labour Code, the relevant information is of general nature during this stage and shall limit to the “total number and categories of employees”, respectively “the number and categories of employees to be subject to redundancy”.
