Law no. 360/2023, provides in art. 46 para. (2) that the persons insured in the public pension system who meet the conditions for enrollment in the pension may choose between granting the old-age pension and continuing the activity, with the annual agreement of the employer, until the age of 70. Essentially, an employee can continue the employment relationship with the employer as long as he wants it, there is the employer’s agreement for the continuation of the employment relationship and the employee does not open his right to pension.
