Objection to enforcement. The extent of pay claims awarded by the court of law following annulment of the dismissal decision

Abstract

For the employer, restoration to the previous situation means payment of all wages and other money claims which it would have paid to its employee if work had been performed.

If the employment relationship between the parties had continued, the employee would have had a pay claim diminished by the effect of the two internal decisions of the general manager. Not taking them into consideration when calculating the compensation would result in the dismissed employee receiving a higher compensation than if he/she had received wages at the monthly due date, which cannot be accepted.
