Abstract

This case of suspension is regulated by the article laid down in the Labour Code regarding the suspension of the individual employment agreement on the employee’s initiative, however, this does not mean that in order to be applicable, it is necessary that the employee should file an application for suspension.

The suspension of the individual employment agreement for absences without leave shall be attributable to the employee, as it is caused by his or her behaviour, and this is the reason for which the legislator has chosen that this case of suspension be regulated by art. 51 of the Labour Code.
