Consideraţii privind reabilitarea disciplinară în contextul legislativ actual

Abstract

In our study we submitted to the text of paragraph 3 of article 248 from Labour Code, which, finally, governs disciplinary rehabilitation after a period of time when legislation was deficient in this matter and the literature strongly proposed the settlement of the institution. The study begins with supporting parallel use of the phrases "legal radiation" and "disciplinary rehabilitation". Here are brought to light conditions provided by law for the disciplinary removal to operate, highlighting aspects that are to be improved in future legislation. We also highlighted the practical importance of the legal institution of disciplinary rehabilitation.
