Abstract

The aim of the present paper is to show some considerations regarding the competence of the civil and military judicial body, viewed both in the context of the evolution of the national legal framework (including from the perspective of the Constitutional Court) and within the relevant European and international instruments. Thus, after an excursus on the theoretical realm relating to establishing the meaning of the notion of competence, followed by the exposition of the forms of competence within the Romanian criminal proceedings and the criminal procedure sanction that occurs in case the legal norms regulating them are violated as well as by a brief overview of the organisation of the military courts and military prosecutors’ offices, a discussion on the competence in case of joining cases before some civil and military courts, respectively, as well...
