Considerations on detention in terms of relating domestic and european regulations and jurisprudence

Abstract

Detention is a measure of temporary restriction of the freedom of movement in Romania, ordered by the magistrate against the alien who could not be removed under escort within the time prescribed by law, in one of the following: a) there is a risk of circumvention of the removal procedure; b) the alien has failed to comply with the voluntary return period granted through the return decision; c) the alien has been declared undesirable person in Romania; d) the alien avoids or hinders the preparation of the return or removal process; e) the alien is subject to the safety measure of expulsion ordered by the court.
