ABSTRACT

One of the legal obligations of any employer in Romania is to ensure the safety and health of workers in all aspects of work. To this end, even from the beginning of the employment relationship and even with a view to concluding an individual employment contract, the worker must present a medical certificate confirming the person’s ability to perform the work for which he is employed. During work relationships, employers have to bear the necessary expenses so that the occupational health physician performs periodical medical checks on employees. However, there are situations where workers refuse to attend these controls, and the solutions offered by judicial practice and legal literature are not unitary, varying between the absence of any sanction for workers and the disciplinary dissolution of the individual labor contract.
