Conflict de interese. Infracţiune prevăzută în art. 11 alin. (1) din Legea nr. 78/2000

Abstract

The act of the civil servant, having the power to issue the approval or authorisation regarding the fire security, to complete for private economic agents the documentation necessary for the issuing of these approvals or authorisations, for the purpose of obtaining sums of money which were not owed to him, meets the conditions for the offence stipulated in art. 11 par. (1) of Law no. 78/2000, and the act of the same civil servant to participate, in the exercise of his office prerogatives, in making the decision of issuing the approval or authorisation regarding the fire security, on the basis of the documentation completed by the civil servant for certain sums of money, meets the conditions for the offence of conflict of interest provided by art. 253¹ of the Criminal Code.
