Abstract

Taking into consideration several updated information of the new Civil Code and the new Civil Procedure Code, this paper aims to present some aspects related to the adoption of regulatory monist system of private law relations.

It can be said that commercial law was absorbed or merged with civil law, as most special rules governed by the Commercial Code, which regulated the special legal regime for trade relations, were overtaken by the new Civil Code. Some of them extended to all private law relations, regardless of the parties of this relation, while some of them still targets only relations on professionals (former known as traders).
