Dismissal of the employee due to psychological unsuitability. Individual employment agreement for home work

Abstract

Upon periodic medical examination, the employee was granted the medical opinion as being psychologically unsuitable for the psycho-pedagogical activity supposed by the position held within the organization, together with the recommendation of changing the workplace.

The work performed for bringing up, caring and educating the children entrusted to the employee’s home, in a family background, because of the specificity of the object of work and of the workplace, cannot be related to the work load for which the normal duration of the working hours is of 8 hours per day and 40 hours per week, with the consequence of the employer’s impossibility to claim the performance of any additional work and of the employee to claim any additional remuneration.
