Dismissal. Evaluation of the achievement of the performance objectives

Abstract

Provisions of art. 69 paragraph 3 of the Labor Code, republished, provide that: "The criteria of paragraph (2) let. d) applies for delimiting the employees after the evaluation of achieving the performance objectives", what happend during this dismissal, the employer choosing to cease the employment contracts only for those who received the rating "unsatisfactory".

Therefore, the law only requires that the separation of employees on other criteria to be carried out after the evaluation of the achievement of the performance objectives, but it does not have restrictive provisions regarding the way in which such a evaluation is applied.

A long as those affected by such a criteria are only those who have obtained the "unsatisfactory" rating, the people who had a higher rating do not justify an interest in complaining that they were excluded from applying...
