Assignment of rights to compensatory measures by equivalent. Effects

Abstract

In the situation where between the party holding the status of former owner or legal or testamentary heir thereof and a third party there is an assignment of rights to reparative measures by equivalent, this convention determines the application of the limit imposed by art. 24 par. 2 and 4 of Law no. 165/2013 even in the absence of compliance with the 15 days deadline for communication of a copy of the transaction deed to the competent authority. The transmission of the deed of assignment, accompanied by the deed terminating the assignment of the debt after exceeding the aforementioned term, attracts the issuance of the compensation decision in favor of the alienator in the amount affected by the legal limit.
