Abstract

Request for the transmission of public interest information, electronically addressed to public authorities. Electronic signature

Point c of the third paragraph of Article 6 of Law 544/2001 provides that the request for information of public interest must include the signature of the applicant, and according to the third paragraph of Article 7 of the same law requesting and obtaining public information can only be achieved if technical conditions are met.

The request sent by e-mail to the defendant authority was not acquired by signature; the electronic document was allowing the possibility to be accompanied by the electronic signature according to the law 455/2001, but this however was not performed by the applicant, so that "the request" was not responded.
