Some aspects regarding the legal assessment of moratorium damages

Abstract

The legal assessment of moratorium damages is applicable in matters relating with an obligation of doing. It has no significance if the obligation executed with delay is a pecuniary one or another obligation of doing.

Moratorium damages are due from the moment the debtor is in default (which may be the due date or the exhaustion date of additional period of execution).

The minimum limit at which is determined the amount of damages is that of the legal interest. If the additional damage and, with the condition to prove them, the creditor is entitled to full compensation of the damage suffered.
