ABSTRACT

The article analyzes the situations involving parental authority after divorce, when decisions are taken by mutual agreement of both parents or, in case of lack of such agreement, by the guardianship court. It refers to those decisions of extreme importance in the evolution and education of a minor, regarding his health, or likely to influence the relationship between the minor and the parent with whom the former does not live in the long term.

Since in practice there are numerous reasons - either justified or not - placing the two parents in opposition and thus compelling them to go to the guardianship court, the author considers it is important to establish which are the major aspects of a minor’s life on which parents should decide together.
