Characterization of forms of damage - as a specific element of civil liability. The perspective of constitutional case law

Abstract

In this section, I have attempted to refer to the characterization of the detailed rules for the manifestation of the damage, as an element of civil liability, in the light of constitutional case-law. To that end, I have presented the damage as a driving force for civil liability, while also highlighting its forms in the context of tortious and contractual liability. The main idea is that the reception of the damage in constitutional case-law focuses on the protection of fundamental rights and the balance of interests of the parties concerned.
