Administrative and procedural capacity of the local council. Standing to be sued in actions for payment of monies

Abstract

According to Article 56 of the Civil Procedure Code, not only persons having the use of civil rights, but also entities without legal personality may be sued if they are duly incorporated. It has not been argued by the parties that the defendant Local Council of the commune has not been legally formed and, in its capacity as an authority of local public administration (Article 87 of Law No 215/2001), is such an entity.

However, as regards ordering the Local Council to pay certain monies, the deputy mayor's allowance, it cannot be held to have standing to be sued.
