Doctrine and case law related issues in the matter of the agricultural and forestry land exchange

Abstract

The new civil Code, adopting a monistic conception resulting in the unification of the provisions of the civil law with those of the commercial law, resulted in significant changes in the matter of the agreements, and these mutations aim at the exchange contract, as well.

In the background of the new general legal framework established by the new civil Code, which governs the exchange contract, the present study aims to analyze the exchange of agricultural and forestry land by reporting the general provisions established by the new civil Code to the provisions of the special regulations in the matter, as well as to the case law and doctrine in the matter of the exchange contract.
