Abstract

The restriction of the capacity to sue or be sued by the dissolution of the legal person - association - is carried out by court decision, at the request of any stakeholder, according to the law. The person interested in the dissolution of an association must justify the capacity to sue or be sued. In this case, the Prefect seeks to protect the general public interest, concerning a social relationship recognised by law, by seeking the restoration of legality, in land matters, as a result of the false acts on the basis of which the association was set up and its unlawful activity.
