Assistance for the conclusion of legal acts in the context of Law no 140/2022

Abstract

This article takes a fresh look at various aspects of the institution of legal aid, including its typology, the broad legal framework applicable and the procedures involved in appointing an assistant. It looks at who can ask, who can be and who appoints the assistant, and the role of the notary public in this context. Other topics include the dreaded confirmation of discernment, the possibility of refusal regarding the assistant's appointment, conflict of interest situations, the report the assistant must submit, the assistant's obligations and complaints against the assistant's work. It also examines the consequences of the rejection of the request for appointment of the assistant and the possibility to appeal the notarial conclusion.
