Abstract

The author recognizes that most of the dilemmas regarding complicity emerge from the manner in which article 50 of the Criminal Code is being interpreted. The main point of the article is not to emphasise the theoretical and practical issues. The legal literature has done a great job at revealing them. There is a fog of doubt regarding how such issues can be solved. In trying to offer some solutions to these issues, the author will orbit around article 50 of the Criminal Code.

The first issue at hand will be the link between the complicity and the offenses committed by oblique intent. Then the author will analyse the interesting aspects concerning complicity in the context of continuing offense and custom offense. Another issue that will be taken into consideration regards the discussion concerning the co-authors of an offense with a qualified subject.
