Abstract

By Constitutional Court Decision no. 601/16 July 2020 published in the Official Gazette no. 88 of 27 January 2021, the exception of unconstitutionality was granted and it was found that the provisions of Art. (1) Civil Code are unconstitutional. The decision was published in the Official Gazette on 27 January 2021, the period of 45 days available to the legislature to correlate the unconstitutional provisions with the provisions of the Constitution expired on 12 March 2021, the date from which the provisions of Article 164 para. (1) of the Civil Code shall be deemed to be repealed.
