ABSTRACT
Labor Code appoint a time limit of six months to sense the court in the case of non-performance collective employment agreement or one of it’s clause (Article 268, para. 1, lett. e), but also one of 3 years, in the case of certain rights sureties wage or some compensation by the employee.
If in the assumption that claim to be wage rights or remedies, the practice, but also the doctrine are uniform throughout with regard to the application of the 3 year period, in the case of other financial entitlements (materials in the run-up to Easter and Christmas bonuses, meal tickets, etc.) are contradictory solutions.
