Abstract

Applicability of the supreme Court’s decisions in referral in the interest of law regarding crimes against the individuals in the context of the new penal Code

The institution of the referral in the interests of the law is fundamental both in ensuring an unitary practice at the level of the law courts and the departments of public prosecution and ensuring the predictability of norm and sanction implementation.

It can be observed that in the new penal Code there are intromissions of the legislator that have changed ruling law texts referring to the infractions against the individuals.
