Appeal against recitals. Admissibility conditions

Abstract

The interests of challenging the recitals, which is a requirement for the appeal admissibility, shall exist whenever the statement of the reasons exceeds the legal nature of a simple recital which defends the solution delivered in the operative part, with the possibility of the opposition of the force of res judicata.

Unbundling the operative part from the recitals shall be the logical consequence of the irrelevance of those recitals.

Rezumat

Interesul atacării considerentelor, condiţie a admisibilităţii apelului, există ori de câte ori statuarea din motivare depăşeşte natura juridică a unui simplu considerent ce susţine soluţia din dispozitiv, fiind posibilă opunerea puterii de lucru judecat.

Disocierea dispozitivului de considerente este consecinţa logică a nonpertinenţei considerentelor.
