Abstract

In this case, it is undisputed that the position and the duties of the respondent belonged to a public administrator with which a management agreement was concluded, under the conditions laid down by Law no. 215/2001 of the local public administration. Therefore, there are obviously contractual relationships between the parties.

The issuer of the challenged order based its deed, as of right, on the provisions of art. 65-67 of the Labour Code, acknowledging the applicability of the rules of the Labour Code on the relationships between the parties.
